With the concept of equity release firmly established in terms of purchasing a residential park home for retirement purposes and the Governments endeavours to extend the protection of the home owner, the residential park homes industry, it seems to us, is set for considerable expansion in the future.
Purchasing a holiday home as a second home can be equally as much if not more, fraught with problems as purchasing a residential park home. Holiday homebuyers, in our experience, are rarely issued with any written documentation. This means the holiday homeowner has no idea of their legal rights much less the term of the licence agreement. Inevitably, a dispute will later arise and the two sides relative positions will degenerate into a ‘who said what' exercise with the site owner occupying the most powerful position.
Whilst you may have your own idea of what you might expect from either a residential park home or holiday home, the park on which it is situated and park owner, it follows that there will be disagreements from time to time principally between the Home Owner, whether holiday or residential and their Park Owner.

We operate a general legal advice helpline during normal office hours Monday to Friday, which you may call to obtain advice on any legal matter associated with park home living and/or holiday caravan ownership. We operate this premium rate helpline under a licence issued by the Government Regulator, PhonePayPlus and we have to carry a specified level of Professional Indemnity Insurance to operate this service. We have kept this cost to 60 pence per minute for a number of years.

Residential Park Home Conveyancing

We are happy to act on your behalf in an attempt to resolve any disputes that may arise provided they involve a park home, holiday home, or site on which either is situated or a local authority. We can act for both the Park Owner and the Home Owner although not in the same dispute; often as an intermediary, negotiating, drafting letters and legal documents that could be used to resolve a dispute before it escalates to court action. As the park home lifestyle becomes increasingly popular, it follows that more and more developers seek to become a part of the success. We are able to provide specialist advice and assistance for those wishing to develop new, and existing sites. The creation of a new site or the expansion of an existing site will undoubtedly be subject to planning permission and thus regulated by Planning Law and Site Licence requirements. Contractual and consumer related issues
Whilst it is rarely acknowledged, much of everything involved in buying a residential park home or holiday home is firmly rooted in contract law. Thus usual contractual rules will apply should a dispute arise. A typical contract law problem occurs when the prospective buyer places a deposit on a residential or holiday home and for some reason wishes to withdraw from the arrangement.
